Terms of Service

Last Updated on March 16th, 2023. These terms of service (the "Agreement") govern your use of the BestAviation.net business directory (the "Directory"). By accessing or using the Directory, you agree to be bound by this Agreement.

Definitions

1. Parties. “you” and “your” refer to you as a user of the Service. A “User” is someone who accesses or in any way uses the service. “We”, “Us”, and “Our” refer to BestAviation.net.
2. Content. “Content” means text, images, photos, audio, video, and all other forms of data or communication. “Your Content” means Content you submit or transmit in connection with the Service. “User Content” means Content that users submit or transmit in connection with the Service. “BestAviation.net Content” means all Content we create and make available in connection with the Service.

Description of Services.

The Directory is an online listing of aviation businesses provided by BestAviation.net. Businesses can list their information, including but not limited to, their name, address, phone number, and website. BestAviation.net does not endorse any business listed in the Directory and is not responsible for the accuracy of the information provided by the businesses.

Registration and Information.

To list your business in the Directory, you must provide accurate and complete information about your business. You are solely responsible for the accuracy of the information provided in the listing, and you agree to update your listing as necessary to ensure that it remains accurate and complete. BestAviation.net reserves the right to reject any listing in its sole discretion.

Fees and Payment.

Listing your business in the Directory is free of charge. BestAviation.net reserves the right to introduce fees in the future, but any such fees will be communicated to you in advance.

Use of the Directory.

The Directory is intended for the personal, non-commercial use of individuals and businesses seeking aviation-related services. You agree not to use the Directory for any commercial purpose, including but not limited to advertising, soliciting, or offering goods or services for sale. You may not use the Directory to harass, defame, or otherwise harm any person or business.

Content

1. Responsibility for your content. You alone are responsible for Your Content, and once posted to BestAviation.net it cannot always be withdrawn. You assume all risks associated with Your Content, including anyone’s reliability on its quality, accuracy, or reliability. You may not imply that Your Content is in any way sponsored or endorsed by BestAviation.net
2. Our Right to Use Your Content. We may use Your Content in several ways, including by publicly displaying it, reformatting it, incorporating it into advertisements and other works. As such, you hereby irrevocably grant us world-wide, perpetual, non-exclusive, royalty-free, assignable, sublicensable, transferable rights to use Your Content for any purpose.
3. Ownership. You own Your Content. We own BestAviation.net Content, including but not limited to visual interfaces, interactive features, graphics and designs.
4. Advertising. BestAviation.net may publicly display advertisements, paid for content, and other information nearby or in association with Your Content. You are not entitled to any compensation for such advertisements. The manner, mode and extent of such advertising are subject to change without specific notice to you.
5. Other. User Content does not necessarily reflect the opining of BestAviation.net. Except as required by law, we have no obligation to retain or provide you with copies of Your Content, and we do not guarantee any confidentiality with respect to Your Content. We reserve the right to remove, screen, edit, or reinstate User Content at our sole discretion for any reason or no reason, and without notice to you.

Disclaimer of Warranties.

BestAviation.net makes no representations or warranties of any kind, express or implied, regarding the Directory or the businesses listed therein. BestAviation.net does not guarantee the accuracy, completeness, or timeliness of the information provided in the Directory. BestAviation.net disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability.

In no event shall BestAviation.net be liable for any damages whatsoever, including but not limited to direct, indirect, incidental, special, or consequential damages, arising out of or in connection with the use or inability to use the Directory or the businesses listed therein.

Indemnification.

You agree to indemnify and hold harmless BestAviation.net, its officers, directors, employees, agents, and affiliates from any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Directory or your breach of this Agreement.

Modification of Agreement.

BestAviation.net may modify this Agreement from time to time in its sole discretion. Your continued use of the Directory following any such modification constitutes your agreement to be bound by the modified Agreement.

Governing Law and Jurisdiction.

This Agreement shall be governed by and construed in accordance with the laws of the United States and the state of California, without giving effect to any principles of conflicts of law. Any legal action or proceeding arising out of or in connection with this Agreement shall be brought exclusively in the state or federal courts located in San Francisco, California.

Entire Agreement.

This Agreement constitutes the entire agreement between you and BestAviation.net with respect to the Directory and supersedes all prior or contemporaneous communications.
